Legal Preamble
These terms ("Terms" or "Founding Creators ToS") govern access to the Founding Creators program ("Program") of the WonderLive platform ("Platform"), operated by WonderLive Suisse SARL, located at rue du Centre 156, Saint-Sulpice, Switzerland ("WonderLive" or "We").
These Terms apply to all content creators ("Creator" or "You") accepted into the Program and complement:
- General Terms of Use (Creator ToS)
- Privacy Policy
- Any specific contract concluded with WonderLive
In case of conflict, the provisions most protective of the Creator shall prevail.
By accepting these Terms, the Creator acknowledges having read, understood and accepted this document in its entirety.
Purpose and Definitions
1.1 Purpose
The Founding Creators Program offers duly selected content creators a 0% WonderLive commission for life on tips received on the Platform, subject to ongoing compliance with the conditions listed below.
This offer is exceptional and personal. It is reserved for a maximum of 300 creators and recognizes their initial contribution to building the WonderLive ecosystem.
1.2 Essential Definitions

| Regular Activity | Minimum 2 original pieces of content per month on the Platform + minimum 1 interaction per week with the community. Tolerated pause: maximum 60 consecutive days (with notification if > 30 days). |
| Content Drift | Substantial and persistent shift toward content that seriously and repeatedly violates WonderLive values. A responsible editorial thematic change ≠ drift. |

Founding Creators Program Benefits
2.1 0% Commission for Life
- + WonderLive takes 0% commission on all Tips received
- + Creator receives 100% of gross Tips amount (before external PSP/store fees)
- + This benefit applies only to Tips and excludes other revenue sources
- + Benefit valid for life, as long as sections 6-7 conditions are met
2.2 Founding Creator Badge
- + Verified and permanent "Founding Creator" badge displayed on Creator profile
- + Distinguishes Founding Creator from other creators
- + Signals early contribution to the WonderLive community
- + Non-transferable: inseparable from Creator's account
2.3 Early Access to Features
- + Priority access to new features, products, services
- + Access according to WonderLive's roadmap, subject to availability
2.4 Support Priority
- + Priority onboarding and personalized assistance from WonderLive team
- + Support for initial setup, understanding tools, revenue optimization
- + Dedicated contact for operational and productive questions (non-legal)
2.5 Product Pilot Participation
- + Priority opportunity to participate in product tests, co-marketing campaigns, strategic initiatives
2.6 Evolution of Secondary Benefits
- + These benefits (2.2-2.5) are specific to the Program and may evolve, while respecting core commitments
Any substantial modification to secondary benefits will be notified with at least 30 days notice.
Limitation and Nature of the Offer
3.1 Limited Capacity
- - Maximum number of spots: 300 Founding Creators
- - WonderLive reserves the right not to allocate all spots if applications do not meet eligibility criteria
3.2 Personal and Non-Assignable Nature
- - Founding Creator status is personal and inseparable from the validated Creator or legal entity
- - Status cannot be sold, rented, assigned, transferred or inherited
- - Any attempt to assign = immediate revocation without compensation
- - Change of owner/control = suspension and status re-evaluation
3.3 No Performance Guarantee
- - No guarantee of revenue, performance, or profitability
- - No guarantee that Creator will attract users or receive Tips
- - No commitment from WonderLive to promote content or increase visibility
WonderLive provides infrastructure; commercial success depends on Creator's content, community engagement and market dynamics.
Eligibility Criteria for Program Entry
4.1 Creator Profile
- - Independent creator, creative organization, studio, collective, producer, independent label
- - Minimum existing audience: 10,000 followers combined across one or more public platforms (YouTube, TikTok, Instagram, Twitch) OR equivalent community through direct channels
- - Legal residence: Creator or organization based in European Union or Switzerland (focus on French-speaking region)
4.2 Content Quality and Alignment
- - Value provided: content deemed educational, entertaining, inspiring, creative, with regular production and editorial consistency
- - Non-toxicity: absence of content focused on harassment, hate, promotion of illegalities, or scams
- - Alignment with WonderLive values: respect for diversity, protection of minors, transparency, integrity
4.3 Authentic Community Engagement
- - Real engagement: signals of substantial interaction, not just vanity metrics (purchased followers, artificial views)
- - Retention rate: proof of loyal audience, for example retention rate ≥ 30% month over month
Application and Selection Process
5.1 Application
Via dedicated form or URL provided by WonderLive. Required information: social links, audience size, themes, country, motivations, etc.
5.2 Analysis
Identity / legal structure verification. Content and audience analysis (quantitative + qualitative). Verification of negative signals.
5.3 Decision
Acceptance as Founding Creator OR Standard Creator. WonderLive may offer Standard status with mention of possibility to join a later wave.
5.4 Confirmation
Notification by email/in-app. Integration of terms into ToS / specific contract if necessary.
Conditions for Maintaining 0% for Life
The 0% commission benefit is valid as long as the following 4 conditions are cumulatively met:
6.1 Annual Renewal and Status Review
- - Founding Creator status is intended for life, but is subject to annual review by WonderLive
- - As long as conditions 6.2-6.5 are met, status is automatically renewed for 1 additional year
- - In case of issues (rule violations, content drift, fraud), WonderLive may decide not to renew and switch to standard model (15% commission)
6.2 PILLAR 1 — Legal Compliance and Rules
Legal Content
What is allowed:
- + Ongoing compliance with applicable Swiss and European laws
- + Respect for copyright
- + Respect for privacy
What is prohibited:
- - Illegal content: incitement to hatred, terrorism, exploitation, glorification of violence
- - Defamation: false accusations, insults, harassment of identifiable individuals or groups
- - Fraud: false product claims, fake testimonials, broken promises
Commercial Transparency
What is allowed:
- + If sponsored or paid content, clearly mark it: #ad, #sponsored, video disclaimer
- + If promoting investments/crypto/finance, include mandatory disclaimer
- + Comply with Swiss/EU regulations on misleading advertising and influencers
What is prohibited:
- - Unregulated cryptocurrencies without risk disclaimer
- - Gambling/betting
- - Misleading or non-compliant training/coaching
- - Prohibited products/services (drugs, weapons, counterfeits)
6.3 PILLAR 2 — Minimum Activity and Ecosystem Contribution
Activity Thresholds
What is allowed:
- + Minimum 2 original pieces of content per month on WonderLive (lives, videos, posts, stories)
- + Minimum 1 interaction per week with the community
- + No more than 60 consecutive days of absence without prior notification
WonderLive understands human life. We don't remove status without explanation. We prefer to adapt on a case-by-case basis.

6.4 PILLAR 3 — Practice Integrity (No Fraud)
What is prohibited:
- - No tip fraud: massive purchase of fictitious tips, bot farms, metric manipulation
- - No community scams: sale of fictitious VIP access, promised content never delivered, financial scams
- - No payment manipulation: deliberate circumvention of WonderLive payment system
- - No spam: mass message spam, massive duplicate content, bot usage
- - No harassment: harassment of other users, creators or WonderLive team
6.5 PILLAR 4 — Ongoing Alignment with WonderLive Values
What is ALLOWED (Creative evolution accepted)
What is allowed:
- + Responsible thematic change: Switching from education to cultural critique, Gaming → DIY / Art / Education, etc.
- + Editorial evolution: New tone, new style, more provocative. Responsibly handled sensitive/critical topics.
- + Creative pivot: Experimental exploration, format diversification.
- + New partners: Collaborations with other creators/brands aligned with the law.
- + Editorial disagreement: You can criticize WonderLive publicly (factually).
Key principle: We tolerate creative evolution, not just immobility.
What constitutes DRIFT (Risk)
What is prohibited:
- - Deliberate toxicity: Targeted harassment, calls to hate or violence, cybersexism
- - Dangerous content: Promotion of illegal activities (drugs, weapons, exploitation)
- - False advice without disclaimer: Financial/medical/legal advice without qualification
- - Misleading advertising: Fake testimonials, broken promises, scams
- - Risk to minors: Sexualized content, exploitation, inappropriate exposure
Our Commitment in Case of Doubt
- - "In case of doubt about an editorial change, we will prioritize dialogue before any decision."
- - Before revocation for alleged "drift", we talk to you
- - We explain precisely what's problematic (with examples)
- - You have a reasonable time to respond/correct
6.6 Procedure in Case of Non-Compliance
Step 1: Warning and Notification (Days 1-5)
WonderLive notifies the Creator by email + in-app notification with the identified problem, the violated rule and the compliance deadline (usually 30 days).
Step 2: Compliance Period (Days 5-35)
Creator has 30-90 days to correct: remove problematic content, add missing disclaimers, change behavior. WonderLive remains accessible and collaborative.
Step 3: Re-evaluation (Days 35-95)
Scenario A: Compliance achieved → Status renewed. Scenario B: Partial compliance → New deadline. Scenario C: No improvement → Formal sanctions.
Stability and Sustainability of the 0% Benefit
7.1 Base Commitment
WonderLive commits contractually to maintain the 0% commission on Tips for Founding Creators, as long as the account respects the framework set out in sections 6.2-6.5 and WonderLive can remain economically viable.
7.2 Minimum Commitment Duration
WonderLive commits to maintaining 0% without modification until this date, except in case of insurmountable legal or economic force majeure. After December 31, 2029, the 0% remains maintained, except formal notification of modification.
Minimum commitment: 3 years until December 31, 2029.
7.3 Annual Reviews and Status Maintenance
Each anniversary of the acceptance date, WonderLive conducts an annual review of Founder status considering compliance with conditions, contribution to the ecosystem and WonderLive's economic viability.
- - Automatic renewal for 1 additional year
- - Maintenance of 0% with additional conditions (e.g., increased engagement)
- - Transition to alternative benefit in case of major change
7.4 Major Changes: Notification Procedure
Before any change, WonderLive seeks solutions to preserve 0% or a very similar benefit, communicates in advance with a minimum notice period of 90 days, and proposes an alternative reducing impact.
7.5 Worst Case Scenario: Protection of Exceptional Benefit
If, despite all efforts, the strict 0% is no longer viable for project survival, WonderLive commits to:
- - Preserve an exceptional benefit: commission capped at 5-7% vs 15% standard
- - OR 50% reduction on standard commission (7.5% vs 15%)
- - Clearly explain the reasons for the change
- - Allow a reasonable transition period (minimum 90 days notice)
- - Option for Founding Creators to terminate contract without penalty
Scope of the 0% Benefit
8.1 Application Limits
0% applies only to tips paid to Founding Creators on WonderLive, excluding external PSP/store fees.
- - 0% does not apply to: Subscriptions, Paid lives, Marketplace, Advertising and sponsorships, Grants or bounties
8.2 Clarity and Traceability
- - Clearly display in Creator dashboard which revenues are subject to 0% vs other rates
- - Provide detailed reports: monthly CSV/PDF export showing breakdown
- - Offer traceability API for Creators to verify calculations
External Fees (PSP, Stores, Banks)
9.1 WonderLive's Limitation of Liability
WonderLive does not control external technical fees applied by: Payment processors (Stripe, PayPal, Wise) typically 1-2% + fixed fees, Apple/Google app stores 30%, Banks exchange and transfer fees.
9.2 Transparency Commitment
- - Negotiate the best rates with payment processors
- - Pass any economic gains to the Creator
- - Clearly display third-party fees in Creator interface
9.3 Meaning of 0%
0% means: WonderLive takes no additional commission, 100% of gross tip amount is paid to Creator before third-party fees. Does not exclude independent third-party fees.
Mutual Limitation of Liability
10.1 WonderLive Liability Cap
WonderLive's total cumulative liability shall not exceed the total amount of tips received in the 12 months preceding the claim, OR CHF 1,000 (if no tips received), with a guaranteed minimum of CHF 500.
10.2 Creator Liability Cap
Creator's civil liability is capped at 200% of total tips received in the 12 months preceding the claim, OR CHF 2,000 (if no tips received).
10.3 Mutual Indemnification
Creator guarantees and agrees to indemnify WonderLive against any claim arising from: intellectual property violation, privacy, defamatory content, misleading promotional content, illegal content, personal data.
Personal Data Protection (GDPR and Swiss nDPA)
11.1 Data Processing
WonderLive processes Creator's personal data for: contract execution, legal obligations, legitimate interest, explicit consent.
11.3 Creator Rights
- - Access: Request a copy of all stored personal data
- - Rectification: Correct inaccurate/incomplete data
- - Deletion: Request data deletion (with legal exceptions)
- - Portability: Receive data in structured format for transfer
- - Objection: Object to marketing processing
11.4 Data Security
- - Encryption in transit: HTTPS/TLS 1.2 minimum
- - Encryption at rest: AES-256
- - Authentication: password hashing (bcrypt/Argon2), optional 2FA
- - Annual pentests / audits by independent third party
- - Incident response: notification within 72h in case of breach (GDPR art. 33)
Applicable Law, Jurisdiction, and Dispute Resolution
12.1 Applicable Law
These Terms are governed by Swiss law (Code of Obligations, Swiss federal laws) + European Union law for GDPR/DSA provisions.
12.2 Competent Jurisdiction
Any dispute arising from these Terms falls under competent Swiss courts according to Swiss Civil Procedure Code rules. Language of proceedings: French.
12.3 Mandatory Pre-Litigation Procedure

Acceptance and Entry into Force
13.1 Consent and Acceptance
- - Have read, understood and accepted these Terms in full

13.2 Entry into Force
These Terms enter into force on the Creator's acceptance date (click or electronic signature) and remain in force for life for each renewal year.
Modification of these Terms
14.1 Minor Changes
Clarifications, typo corrections: entry into force almost immediately OR 15 days, notification by informational email.
14.2 Substantial Changes
- - Prior notification: email + in-app notification + publication on dedicated page
- - Minimum deadline: 30 days before entry into force (extendable to 90 days)
- - Right of objection: Creator may terminate contract without penalty
Termination and End of Program
15.1 Termination by Creator
Creator may terminate these Terms at any time, without required cause. Email to legal@wonderlive.com, 14-day withdrawal period, switch to Standard Creator (15% commission).
15.2 Termination by WonderLive
Valid reasons: Unrepaired serious violation, 2+ months inactivity without response, Detected fraud, Force majeure. Written notification with explicit reasons, minimum 30 days notice.
Final Provisions
16.2 Entirety of Agreement
These Terms, Creator ToS, Privacy Policy, any specific contract constitute the entire agreement between WonderLive and the Creator on the subject.
16.3 Severability Clause
If a clause is deemed invalid by a Swiss/EU court, it is removed or minimally modified for compliance. The rest of the contract remains in force.
16.6 Language and Translations
These Terms are written in French. In case of conflict, the French version prevails.
FAQ — Frequently Asked Questions
Q1: If my audience drops, do I lose the status?
No. Audience drop ≠ reason for revocation. As long as you're active and legal, you remain a Founder.
Q2: If I change my theme (gaming → education)?
OK. Responsible thematic change ≠ drift. If it's legal, it's allowed.
Q3: I'm on a 3-month hiatus. Do I lose my status?
If you notify WonderLive, we can adapt. If you silently disappear > 60 days → after 2 months we try to contact you, then after 3 months without response → we consider revocation. But we won't surprise you.
Q4: I publish sponsored content. What changes?
You must clearly mark it (#ad, #sponsored). It's required by Swiss/EU law. WonderLive 0% still applies.
Q5: Can the 0% commission disappear?
Not until December 31, 2029 (minimum 3-year guarantee). After that, it remains maintained except 90-day notification. Worst case = 5-7% instead of 0%.
Q6: Are there hidden fees?
No. Stripe/Apple/bank fees are visible. WonderLive takes 0%. If you see a surprise = write to support@wonderlive.com.
Q7: What are my GDPR rights?
Access, rectification, deletion, portability, objection. See section 11.3 + Privacy Policy.
Q8: How do I contest a WonderLive decision?
appeals@wonderlive.com. Response in 15 days. If unsatisfied → Swiss mediation (see section 12).
Q9: Can I sell my Founder status?
No. Status is non-assignable and personal. Any sale attempt = immediate revocation.
Q10: What if WonderLive goes bankrupt?
Tips received are your property (not WonderLive assets). But the 0% contract ends. We seek solutions before (section 7.5).
